My impression that it would/should still work.
I agree with that. However, the question is always: How often does this happen? With the current gem version there should be no need to use the set up from above, and if there still is, the overall architecture seems questionable.
Don't get me wrong: I agree that this case should work, however I am reluctant to put significant work into a use case that seems pretty rare to me - so unless more people start complaining about this I'd consider this an edge case.
But if you'd like to whip up a pull request you'd be more than welcome..;)

I would agree with you in regards to this being a pretty odd edge case. I may have been using the Gem at an interesting transition (no pun intended) period that caught it. The new interface does make things much cleaner/readable in the code.
I may see if I can pull together some code to address the issue when I get a little bit more time (or others start to run into the issue as well). I don't have an ETA on that right now due to some time constraints.
