There is a remote possibility with a different approach in the future (with its own caveats) but with the current possibility, no. The new MBPs always push the mirrored content beneath the notch, no matter what the aspect ratio is. This is because the notch necessitates a special handling of the menu (+special menu size) which is not happening on an external display (which is mirrored to the internal display) even if it is a dummy. I think Apple got itself into a mess with the notch and some use cases simply can't work with it well.
But my hope is that there will be a fix for the resoution woes of M1 and BetterDummy won't be needed as a workaround for this (can stay around for other, less pronounced use cases, like headless servers etc).
