It's legal to add an element where index == size():

IndexOutOfBoundsException - if the index is out of range (index < 0 || index > size())

That's what we're doing if the child's depth indicates that it should be positioned last.

Are you seeing an OOB exception in real code?

This is most probably my bad, you are right. I've seen this exception but
it's probably something to do with my code base, cause I can't reproduce
this anymore. This is really a false alarm.
