Fails to compile `(eieio "1.3")` not found about gist.el

Maybe it's not gist.el, but recent (GNU Emacs 24.3.50.1) package.el that's at fault? The header in gist.el indicates eieio 1.3, but according to the docs that's the minimal version:

The cadr of each sub-list is the minimum acceptable version number, as a string. For instance:
          ;; Package-Requires: ((gnus "1.0") (bubbles "2.7.2"))
The package code automatically defines a package named ‘emacs’ with the version number of the currently running Emacs. This can be used to require a minimal version of Emacs for a package.

yeah, that doesn't look like gist.el's fault. But I'm going to require 1.4 in the upcoming 1.2 version anyway...
