More specifically, this error occurs due to internal github changes like defunkt/gist#79
It's getting a 422 response back. This occurs whether gist-use-curl is true or not.

Looks like gist.el has to be rewritten to use the API?

since API < v3 will not survive much longer, I suggest you give the 'next' branch a shot. I just updated the README there to cover (hopefully) the main install scenarios
