Think I found out why. The server is not running php 5.3

Yep. Sorry -- the 'normal' way for testing for older versions of PHP is to put the simplified PHP in one file, run your tests, and then once it's all good, include another file... but since this is was built to be in a single script, I couldn't do that. I might be able to rework the code... but PHP 5.3 is nearing end of life already...
