Indeed this is a bug. The difference is this:

            /*#__PURE__*/ _jsxQ("p", null, null, foo("test"), 1, null, {
                fileName: "app.tsx",
                lineNumber: 16,
                columnNumber: 7
            }),
            /*#__PURE__*/ _jsxQ("p", null, null, foo`test`, 3, null, {
                fileName: "app.tsx",
                lineNumber: 17,
                columnNumber: 7
            }),

The flags on the second jsx invocation indicate that it's static, and indeed you can't assume that a template string function is pure.

The meaning of the flag is seemed here:

export const static_subtree = 1 << 1;
