Cause of the Bug

Line 110 pairs = find(conv(foo(indx), [1 1]) == 2); attemps to sum the neighbouring indices. By default, MATLAB conv function pads the data with 0 values on both ends during convolution and creates an array that is potentially larger than the first input array. This in turn creates indices that are larger than the length of indx array.

Possible Fix

Use 'valid' option in conv to only sum actual elements and no 0 paddings.
